Abstract
Tindakan skorsing oleh pengusaha dalam praktik adalah merupakan suatu sanksi atas
pelanggaran yang dilakukan oleh pekerja. Pemasalahan timbul ketika skorsing tanpa
batas waktu dan tanpa pembayaran upah, sehingga tidak ada kepastian bagi pekerja
akan kelangsungan pekerjaan dan penghasilannya. Penelitian ini ditujukan untuk
mendesripsikan pertimbangan hakim dalam Putusan No. 835 K/Pdt.Sus-PHI/2018
juncto Putusan No. 195/Pdt.Sus-PHI/2017/PN Mdn. mengenai tindakan skorsing
tanpa batas waktu dan perlindungan hukum terhadap pekerja dalam proses
penyelesaiannya.
Jenis penelitian hukum ini adalah penelitian hukum normatif, ditujukan hanya pada
data sekunder berupa bahan hukum primer yaitu peraturan perundang-undangan dan
Putusan Pengadilan yang sifatnya mengikat, didukung bahan hukum sekunder dan
bahan hukum tersier. Data dikumpulkan melalui penelitian kepustakaan. Pendekatan
penelitian adalah pendekatan perundang-undangan, pendekatan konseptual dan
pendekatan kasus pada Putusan Pengadilan. Analisis data dilakukan secara kualitatif.
Hasil penelitian menunjukkan, pertimbangan Hakim mengenai tindakan skorsing
tanpa batas waktu yang dilakukan KPUM terhadap pekerjanya dalam Putusan No.
853/K/PDT.SUS-PHI/2018 juncto Putusan No. 195/Pdt.Sus-PHI/2017/PN Mdn.
adalah merupakan pemutusan hubungan kerja. Pertimbangan Hakim tentang
pemberian uang pesangon 2 (dua) kali ketentuan Pasal 156 ayat (2) juga sudah sangat
tepat dan memberi kepastian hukum, karena tidak terdapat bukti adanya kesalahan
ataupun pelanggaran yang dilakukan oleh Penggugat selaku pekerja. Perlindungan
hukum yang diberikan kepada pekerja dalam proses penyelesaian kasus a quo adanya
lex specialist dalam UU No. 2 Tahun 2004 tentang PPHI adalah berdasarkan konsep
kepastian hukum atas terwujudnya asas peradilan yang sederhana, cepat dan biaya
ringan. Perlindungan hukum terhadap proses perolehan atas upah selama pekerja
diskors telah diatur secara tegas dalam Pasal 155 ayat (3) UU No. 13 Tahun 2003
juncto Pasal 96 UU No. 2 Tahun 2004, tetapi harus dimintakan oleh Penggugat dan
disertai alat bukti yang cukup di dalam persidangan.
Kata Kunci: Pemutusan Hubungan Kerja, Perlindungan Hukum, Skorsing / In practice, suspension by employers is a sanction for violations committed by
workers. Problems arise when suspension is indefinite and without payment of wages,
so that there is no certainty for workers regarding the continuation of their
employment and income. This research is aimed at describing the judge's
considerations in Decision No. 835 K/Pdt.Sus-PHI/2018 in conjunction with Decision
No. 195/Pdt.Sus-PHI/2017/PN Mdn. regarding indefinite suspension and legal
protection for workers in the resolution process.
This type of legal research is normative legal research, aimed only at secondary data
in the form of primary legal materials, namely statutory regulations and court
decisions which are binding in nature, supported by secondary legal materials and
tertiary legal materials. Data was collected through library research. The research
approach is a statutory approach, a conceptual approach and a case approach to
Court Decisions. Data analysis was carried out qualitatively.
The research results show that the judge's considerations regarding the action of
indefinite suspension carried out by the KPUM against its workers in Decision No.
853/K/PDT.SUS-PHI/2018 in conjunction with Decision No. 195/Pdt.Sus-
PHI/2017/PN Mdn. is a termination of employment. The Judge's consideration
regarding the provision of severance pay 2 (two) times the provisions of Article 156
paragraph (2) was also very appropriate and provide legal certainty, because there
was no evidence of any error or violation committed by the Plaintiff as a worker. The
legal protection provided to workers in the process of resolving a quo cases is the
presence of a lex specialist in Law no. 2 of 2004 concerning PPHI is based on the
concept of legal certainty for the realization of the principles of justice that is simple,
fast and low cost. Legal protection for the process of obtaining wages while workers
are suspended has been strictly regulated in Article 155 paragraph (3) of Law no. 13
of 2003 in conjunction with Article 96 of Law no. 2 of 2004, but must be requested by
the Plaintiff and accompanied by sufficient evidence at trial.
