Abstract

Malaysia is a country that has various ethnicities, religions, languages and ideologies. There are 3 ethnic groups occupying Malaysia. The most populous ethnic group is the Malay ethnic group because it has occupied Malaysia the longest, followed by China, and India as the migrant tribe. Just like the other multi-ethnic countries, there are problems faced by Malaysia in building the nation. Malaysia's refusal to ratify an International Convention on The Elimination of All Forms of Racial Discrimination is an issue that is being faced by the Malaysian government. In fact, the ICERD ratification is seen as a step forward for a country to end racial discrimination and promote elements of heterogeneity in the state system. ICERD is considered as a threat to the religion of Islam and it can eliminate the special privileges for ethnic Malays that are listed in Article 153 of the Federal Constitution of Malaysia. The purpose of this study is to find out the reasons for Malaysia's refusal to ratify ICERD and to find out the response from the Human Rights Organization regarding discrimination in Malaysia. The research methodology used is descriptive method with a qualitative approach. The results of the research show that, the reason for the rejection of ICERD ratification is that the international convention is considered contrary to the Federal Constitution of Malaysia, Article 153 and it is against the religion of Islam. The Malays do not want their privileges lost if Malaysia decides to ratify ICERD. Human Rights Organizations respond to Malaysia's decision assume that Malaysia's decision not to ratify is a real concern for political commitment and Malaysia does not have a clearly articulated plan in the spirit of promoting and also protecting human rights in Malaysia. / Malaysia merupakan negara yang memiliki beragam suku, agama, bahasa, dan ideologi. Ada 3 kelompok etnis yang menduduki Malaysia. Kelompok etnis dengan populasi terbanyak adalah etnis Melayu karena paling lama menduduki Malaysia, diikuti dengan Cina, kemudian India sebagai suku pendatang. Sama seperti negara multi-etnis lainnya, ada masalah yang dihadapi oleh Malaysia dalam membangun sebuah negara salah satunya adalah masalah diskriminasi rasial. Penolakan Malaysia untuk meratifikasi konvensi internasional tentang penghapusan semua bentuk diskriminasi rasial adalah masalah yang sedang dihadapi oleh pemerintah Malaysia. Padahal, ratifikasi ICERD dianggap sebagai langkah maju bagi suatu negara untuk mengakhiri diskriminasi rasial dan mempromosikan unsur-unsur heterogenitas dalam sistem negara. ICERD dianggap sebagai sebuah ancaman terhadap agama Islam dan dapat menghilangkan hak istimewa untuk etnis Melayu yang tercantum dalam Pasal 153 Konstitusi Federal Malaysia. Tujuan dari penelitian ini adalah untuk mengetahui alasan penolakan Malaysia untuk meratifikasi ICERD dan untuk mengetahui respon dari Organisasi Hak Asasi Manusia mengenai diskriminasi di Malaysia. Metodologi penelitian yang digunakan adalah metode deskriptif dengan pendekatan kualitatif. Hasil dari penelitian menunjukan bahwa, alasan dari penolakan ratifikasi ICERD adalah karena konvensi internasional tersebut dianggap bertentangan dengan Konstitusi federal Malaysia, Pasal 153 dan bertentangan dengan agama Islam. Masyarakat Melayu tidak mau hak istimewa mereka hilang jika Malaysia memutuskan untuk meratifikasi ICERD. Organisasi Hak Asasi Manusia menanggapi keputusan Malaysia menganggap bahwa keputusan Malaysia untuk tidak meratifikasi merupakan keprihatinan nyata pada komitmen politik dan Malaysia tidak memiliki rencana yang diartikulasikan dengan jelas dalam semangat mempromosikan dan juga melindungi hak asasi manusia di Malaysia.
