Abstract

Penyelenggara Laku Pandai memiliki kegiatan berupa penyediaan layanan perbankan dan/ atau layanan keuangan lainnya yang dilakukan tidak melalui jaringan kantor, namun melalui kerjasama dengan pihak lain dan perlu didukung dengan penggunaan sarana teknologi informasi. Pasal 34 POJK Nomor 19/POJK.03/2014 mengatur mengenai Penyelenggara Laku Pandai yang wajib menerapkan prinsip perlindungan konsumen. Tesis ini menggunakan metode penelitian Yuridis Normatif. OJK harus melakukan pemeriksaan secara berkala dan terus memperhatikan peraturan perundang-undangan yang terbit sehingga dapat melakukan sinkronisasi dalam penerbitan POJK demi memberikan perlindungan kepada nasabah yang menitipkan uangnya kepada Penyelenggara Laku Pandai. OJK harus mensosialisasikan POJK yang baru diterbitkan kepada masyarakat dengan harapan masyarakat luas paham dan mengerti bagaimana melindungi hak-hak mereka selaku nasabah. Masyarakat juha harus berperan secara aktif sehubungan dengan adanya dugaan penyelewengan tindakan oleh Penyelenggara Laku Pandai dengan cara melakukan pelaporan kepada OJK sehingga OJK dapat segera melakukan pemeriksaan kepada Penyelenggara Laku Pandai tersebut. POJK Nomor 19/POJK.03/2014 tidak mengatur secara jelas dan rinci mengenai bagaimana proses pemeriksaan terhadap kewajiban Penyelenggara Laku Pandai dalam hal perlindungan data nasabah, justru yang mengatur adalah POJK Nomor 1/POJK.07/2013. OJK memiliki fungsi untuk menyelenggarakan sistem pengaturan dan pengawasan yang terintegrasi terhadap keseluruhan kegiatan di dalam sektor jasa keuangan dimana hal tersebut diaturdalam UU OJK. OJK melaksanakan Pemeriksaan terhadap Bank melalui pemeriksaan secara berkala paling sedikit 1 (satu) tahun sekali untuk setiap Bank dan pemeriksaan sewaktu-waktu apabila terdapat laporan dari masyarakat terkait adanya dugaan pelanggaran kewajiban bank. Pemeriksaan meliputi pemeriksaan terhadap aspek kegiatan usaha Bank. Pemberian sanksi terhadap Penyelenggara Laku Pandai yang tidak melaksanakan kewajiban perlindungan data nasabah diatur dalam POJK Nomor 22 Tahun 2023, dimana akan dikenai sanksi administratif, denda administratif dan sanksi pidana sebagaimana diatur dalam UU P2SK. / Laku Pandai Organizers have activities in the form of providing banking services and/or other financial services that are carried out not through the office network, but through cooperation with other parties and need to be supported by the use of information technology facilities. Article 34 of POJK Number 19/POJK.03/2014 regulates Laku Pandai Organizers who are obliged to apply the principle of consumer protection. This thesis uses the Normative Juridical research method. OJK must conduct periodic inspections and continue to pay attention to the issued laws and regulations so that it can synchronize the issuance of POJK in order to provide protection to customers who entrust their money to the Laku Pandai Operator. OJK must socialize the newly issued POJK to the public in the hope that the wider community understands and understands how to protect their rights as customers. The community must also play an active role in connection with the alleged misappropriation of actions by the Laku Pandai Organizer by reporting to the OJK so that the OJK can immediately conduct an examination of the Laku Pandai Organizer. POJK Number 19/POJK.03/2014 does not regulate clearly and in detail how the audit process for the obligations of Laku Pandai Operators in terms of customer data protection, in fact what regulates is POJK Number 1/POJK.07/2013. OJK has the function of organizing an integrated regulatory and supervisory system for all activities in the financial services sector where this is regulated in the OJK Law. OJK conducts an audit of the Bank through periodic inspections at least once every 1 (one) year for each Bank and an audit at any time if there are reports from the public regarding alleged violations of bank obligations. The audit includes an examination of aspects of the Bank's business activities. The provision of sanctions against Laku Pandai Operators who do not carry out customer data protection obligations is regulated in POJK Number 22 of 2023, where they will be subject to administrative sanctions, administrative fines, and criminal sanctions as stipulated in the P2SK Law.
