Abstract

Permasalahan utama penelitian ini adalah kerja sama Indonesia-Malaysia dalam perlindungan PMI masih belum memperoleh kepastian karena MoU tahun 2011 telah habis berlaku pada tahun 2016, namun belum juga adanya kelanjutan mengenai MoU terbaru. Hal ini menyebabkan perlindungan terhadap PMI masih mengalami banyak persoalan dan hambatan, ditandai dengan meningkatnya pengaduan PMI dari tahun ke tahun. Malaysia saat ini menduduki peringkat pertama negara tujuan PMI, sehingga memerlukan topangan berupa perlindungan hukum yang pasti. Tujuan dari penelitian ini adalah untuk mendapatkan gambaran mengenai permasalahan aktual yang dihadapi PMI, menggambarkan dinamika kerja sama Indonesia-Malaysia dalam melindungi PMI pada tahun 2011-2018, dan terakhir untuk mendapatkan gambaran mengenai implementasi kerja sama Indonesia-Malaysia, kemajuan serta hambatannya. Metode yang digunakan dalam penelitian ini adalah metode deskriptif kualitatif. Selain itu, teknik yang digunakan dalam mengumpulkan data adalah studi daring, studi pustaka, serta studi lapangan berupa wawancara dengan PMI di Malaysia dan pejabat BNP2TKI. Hasil dari penelitian ini adalah masalah-masalah mengenai hak PMI belum mampu diatasi kedua negara dari tahun ke tahun, diperburuk dengan belum adanya kesepakatan mengenai MoU terbaru untuk menggantikan MoU terakhir yang telah habis berlaku pada tahun 2016. Masalah-masalah terkait hak mendorong PMI untuk lebih memilih jalur ilegal. Atase Ketenagakerjaan yang dibentuk tahun 2017 belum mampu melindungi dan mengatasi masalah PMI baik legal maupun ilegal secara maksimal. Kerja sama dan program-program yang digagas kedua pemerintah belum mampu menarik minat para PMI karena dianggap merugikan bagi para PMI. Sistem pendataan yang dimiliki oleh Indonesia juga merupakan titik lemah dalam mengatasi masalah PMI ilegal. Hambatan dalam menyepakati MoU terbaru mengenai perlindungan PMI adalah tarik ulurnya kedua pemerintah karena perbedaan kepentingan nasional serta kurangnya program-program kerja sama melalui perundingan bersama antara kedua negara. / The main problem of this research is the cooperation between Indonesia-Malaysia in protecting PMI has not yet been ascertained because the 2011 MoU has expired in 2016, but there hasn't further continuation regarding the latest MoU. This causes protection against to PMI still experiences many problems and obstacles, identified by the increased of the PMI complaints from year to year. Malaysia is currently ranked first in the destination countries for PMI, so it requires support in the form of definite legal protection. The purpose of this study is to get an overview of the actual problems faced by PMI, describe the dynamics of Indonesia-Malaysia cooperation in protecting PMI in 2011-2018, and the last is to get an overview of the implementation of Indonesia-Malaysia cooperation, progress and obstacles. The method used in this research is descriptive qualitative method. Besides, the techniques used in collectingdata are online studies, literature studies, and field studies in the form of interviews with PMI in Malaysia and BNP2TKI officials. The results of this study are the problems regarding the rights of PMI that have not been able to be overcome by the two countries from year to year, exacerbated by the absence of an agreement on the latest MoU to replace the last MoU that had expired in 2016. Issues related to rights encourage PMI to prefer illegal ways. The Labor Attache, which was formed in 2017, has not been able to protect and overcome PMI issues, both legal and illegal, to the fullest. The cooperation and programs initiated by the two governments have not been able to attract the interest of the PMI because it is considered detrimental to the PMI. Indonesia's data collection system is also a weak point in overcoming the problem of illegal PMI.
