Abstract

The rapid development of technology has significantly impacted smartphone usage, making it an essential part of daily life, especially in the field of online transportation services. GrabFood, an online food delivery service by Grab, offers a wide variety of food options through its partnerships with GrabMerchant. The GrabFood system serves consumers through driver-partners who have entered a partnership agreement with a revenue-sharing model with Grab. However, price discrepancies between the order receipt and the app have become one of the reasons for unilateral cancellations by consumers or driver-partners. This issue of price discrepancy constitutes a form of breach of contract that results in driver-partners being the most disadvantaged party. Driver-partners are required to pay the total price of the consumer’s food order in advance, which leads to financial losses. This study aims to provide answers to these issues and further develop existing theories related to unilateral cancellations and Grab’s legal protection mechanisms. The author used empirical normative legal research, focusing on secondary data supported by primary data. The findings reveal that the issues are caused by several factors, such as price discrepancies in the app, fake addresses, parking fees, and unavailable items. Thus, the implementation of the standard operating procedures and code of conduct set by Grab has not been fully applied by all GrabMerchant partners. Grab has made efforts to provide legal protection for driver-partners by offering insurance services and compensation claims. Therefore, the author concludes that the price discrepancies between the app and the order receipt are primarily due to negligence on the part of GrabMerchant in managing the prices listed in the app. This discrepancy results in unmet rights and obligations between driver-partners and consumers, which is contrary to Article 1243 of the Indonesian Civil Code and the Consumer Protection Law. Despite Grab’s efforts to provide legal protection for driver-partners, the implementation remains suboptimal. For instance, GrabAcademy, Grab's SOP program, is not accessed thoroughly by some driver-partners. As a result, essential information and primary terms regarding GrabFood services are not effectively communicated to all partners.
