Abstract

Plastic waste has long been a problem for the international community, including Indonesia. Therefore, there is now a policy to ban the use of single-use plastic bags, which is intended to reduce plastic waste in Indonesia. Statistically, with the policy of banning single-use plastic bags in several regions, the use of single-use plastic bags has been proven to decrease drastically. However, at the same time, the unwitting use of spunbond as an alternative to the single-use plastic ban has the potential to create new environmental issues. Considering Indonesia's waste management capabilities, producers should also be held responsible, including for spunbond as part of the products they produce. The idea of imposing responsibility on producers for waste and/or packaging arising from their products has been accommodated through the concept of Extended Producer Responsibility (EPR). The objective of this research is to address the issue of spunbond waste as a consequence of the single-use plastic bag ban through EPR. The type of research used in this thesis is normative-empirical, with secondary data as the main data and primary data as supporting data. Secondary data is obtained through a literature study, while primary data is obtained through interviews. The type of data analysis approach used is the approach to legal systematics and the approach to legal comparison. Since this research is qualitative, the inductive method is used in analyzing the data. The results of this study show that the existence of a ban on the use of single-use plastic bags causes an increase in spunbond waste, even though spunbond emits more emissions in the production process and is more difficult to recycle. Then, EPR as a policy framework can be used as a solution to the problem of spunbond waste in Indonesia, but spunbond is not yet included in its regulations, and the current EPR system has notable shortcomings. Aiming to make EPR a solution to spunbond problems in Indonesia, EPR regulations must first incorporate spunbond as a mandatory object of EPR. Furthermore, regarding the application of EPR, improvements in EPR implementation are necessary, including enforcing fines for non-compliance and introducing a Deposit Refund System (DRS) to enhance consumer participation.
