Abstract
Perlindungan hukum bagi pasien dalam kasus kelalaian dokter yang berkaitan dengan pelaksanaan informed consent merupakan isu penting dalam bidang hukum kesehatan. Hak atas kesehatan, sebagaimana dijamin oleh Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, menjadi landasan bagi berbagai regulasi, termasuk Undang-Undang Nomor 17 Tahun 2023 tentang. Meski perlindungan hukum telah diatur, praktik informed consent sering kali tidak dijalankan secara optimal, menyebabkan malpraktik medis yang merugikan pasien baik secara fisik, psikologis, maupun materiil. Penelitian ini bertujuan untuk menganalisis pengaturan norma hukum terkait informed consent serta implementasinya dalam memberikan perlindungan hukum bagi pasien. Penelitian ini menggunakan pendekatan yuridis normatif dengan menganalisis peraturan perundang-undangan, putusan pengadilan, dan teori hukum terkait. Data diperoleh melalui studi literatur dan analisis dokumen, termasuk kajian terhadap Putusan Nomor 11/Pdt.G/2019/PN Sangatta sebagai salah satu contoh kasus. Hasil penelitian menunjukkan bahwa pengaturan mengenai informed consent telah termuat dalam berbagai peraturan, namun implementasinya sering kali menghadapi kendala. Dalam kasus tertentu, dokter tidak memberikan penjelasan yang memadai mengenai prosedur medis, risiko, dan alternatif pengobatan, yang mengakibatkan kerugian serius bagi pasien. Selain itu, dokumentasi informed consent yang tidak transparan sering menjadi faktor penyebab sengketa hukum antara pasien dan tenaga medis. Penelitian ini menyimpulkan bahwa pelaksanaan informed consent harus dipandang sebagai hak fundamental pasien dan kewajiban moral dokter. Untuk meningkatkan perlindungan hukum, diperlukan penguatan regulasi dan pengawasan yang lebih ketat, pelatihan berkelanjutan bagi tenaga medis, serta edukasi bagi masyarakat mengenai hak-hak pasien. Dokumentasi yang jelas dan terstandar juga menjadi elemen penting dalam menciptakan akuntabilitas dan kepercayaan dalam sistem kesehatan. Penelitian ini diharapkan dapat memberikan kontribusi bagi pengembangan hukum kesehatan di Indonesia, khususnya dalam upaya mencegah malpraktik medis dan meningkatkan kualitas layanan kesehatan.

Legal protection for patients in cases of doctor negligence related to the implementation of informed consent is a significant issue in health law. The right to health, as guaranteed by the 1945 Constitution of the Republic of Indonesia, serves as the foundation for various regulations, including Law No. 17 of 2023 on Health. Despite the legal protections in place, the practice of informed consent is often not optimally implemented, resulting in medical malpractice that harms patients physically, psychologically, and materially. This study aims to analyze the legal norms governing informed consent and its implementation in providing legal protection for patients. It employs a normative juridical approach by analyzing legislation, court rulings, and related legal theories. Data were collected through literature studies and document analysis, including a review of Decision No. 11/Pdt.G/2019/PN Sangatta as a case study. The findings indicate that regulations on informed consent are well-established but often face challenges in implementation. In some cases, doctors fail to provide adequate explanations regarding medical procedures, risks, and alternative treatments, leading to significant harm to patients. Additionally, non-transparent documentation of informed consent frequently becomes a source of legal disputes between patients and medical practitioners. The study concludes that the implementation of informed consent must be regarded as a fundamental patient right and a moral obligation of doctors. To enhance legal protection, stronger regulations and stricter oversight are needed, along with continuous professional training for medical personnel and public education on patient rights. Clear and standardized documentation is also essential for ensuring accountability and fostering trust within the healthcare system. This research is expected to contribute to the development of health law in Indonesia, particularly in preventing medical malpractice and improving the quality of healthcare services.
