Abstract

Suspension of Payment (Hereinafter referred to as "PKPU") is one of the solutions that can be taken by debtors before being declared bankrupt in the form of a peace agreement. The provisions governing the requirements for a PKPU Application are regulated in Article 2 of Law No. 37 of 2004 concerning Bankruptcy and Suspension of Payment (Hereinafter referred to as the "Bankruptcy Law"). Several cases of PKPU Applications submitted by Private Companies against PT. Persero on the basis of considerations that are not in accordance with Article 2 paragraph (5) of the Bankruptcy Law. In the case of PKPU Number: 425 / Pdt.Sus-PKPU / 2021 / PN.Niaga.Jkt.Pst, the Applicant, namely PT Mitra Buana Koorporindo (Private Company) PKPU Application can be granted against the Respondent PT. Garuda Indonesia (PT. Persero) Tbk. This creates legal uncertainty for a handful of Private Parties who cannot submit their debt payment fulfillment to Creditors which are PT. Persero. This study aims to find the basis for the judge's considerations in granting the PKPU application in decision No.425/PDT.SUS-PAILIT/2021/PN NIAGA JKT PST and the Legal Position of the PKPU Applicant against PT. Persero is in accordance with the Bankruptcy Law in Indonesia. Through case studies and reviewed based on the Bankruptcy Law regulations. The research method used is the normative-empirical legal research method that uses secondary data as the main law, namely by using books, journals, and other secondary data and supported by primary data conducted by the Researcher in interviewing relevant sources in fulfilling the PKPU Application procedure. The results of the study show that there is a classification of PKPU Applicant subjects which are further regulated in the Bankruptcy Law so that in practice it is still often confusing if they are not aware of the existence of these regulations. On the other hand, considering the statement of the source along with the ongoing PKPU case, the existing regulations still do not prioritize the Rights of PKPU Applicants from the Private Sector against PT. Persero. The conclusion is that Private Debtors can apply for PKPU against PT. Persero with the classification of the Legal Subject’s must be in accordance with the requirements in the Bankcruptcy Law and In the case of PKPU Number: 425 / Pdt.Sus-PKPU / 2021 / PN.Niaga.Jkt.Pst has complied with the Bankcruptcy Law.
