Abstract

Penelitian ini bertujuan untuk membandingkan sistem pengupahan sebelum dan sesudah UU Cipta Kerja dan menganalisis perlindungan terhadap hak – hak pekerja dalam hal pengupahan menurut UU Cipta Kerja Jenis penelitian ini adalah penelitian hukum normatif yang sifatnya deskriptif analitis jenis data yang digunakan adalah data sekunder berupa bahan hukum primer, bahan sekunder dan bahan hukum tersier, yang diperoleh dari dari studi kepustakaan. Data hasil penelitian disusun dianalisis secara kualitatif. Pendekatan penelitian yang digunakan ialah pendekatan perbandingan peraturan perundang- undangan bidang ketenagakerjaan sebelum dan sesudah UU Cipta Kerja. Hasil penelitian menunjukkan terdapat beberapa perbedaan sistem pengupahan sebelum dan setelah adanya UU Cipta Kerja, yaitu dalam hal tujuan dan konsep dasar penetapan upah minimum, struktur dan skala upah, jenis upah minimum, ketentuan upah minimum, dan ketentuan pembayaran upah. Perubahan dalam perlindungan hak pekerja pascapemberlakuan UU Cipta Kerja menciptakan dampak yang kompleks. Di satu sisi, undang-undang ini memberikan manfaat positif, salah satunya adalah jaminan pembayaran uang lembur bagi pekerja. Hal ini diharapkan dapat meningkatkan kesejahteraan mereka dan memberikan kejelasan mengenai hak-hak finansial yang harus diterima. Namun, di sisi lain, ada juga dampak negatif yang perlu dicermati. Salah satu isu utama adalah ancaman terhadap kondisi kerja yang layak dan adil, khususnya dalam hal upah yang diterima oleh pekerja. Beberapa pekerja mungkin menghadapi situasi di mana upah yang mereka terima tidak mencerminkan standar hidup yang wajar, serta tidak sesuai dengan kontribusi yang mereka berikan. Ini menunjukkan perlunya perhatian lebih terhadap keseimbangan antara kebijakan yang mendukung pengusaha dan perlindungan hak-hak pekerja agar tidak ada pihak yang dirugikan/ This study aims to compare the wage system before and after the Job Creation Law and to analyze the protection of workers' rights in terms of wages according to the Job Creation Law. This research is a normative legal study that is descriptiveanalytical in nature. The type of data used is secondary data consisting of primary legal materials, secondary materials, and tertiary legal materials, obtained through literature study. The data collected from the research is analyzed qualitatively. The research approach used is a comparative approach to labor legislation before and after the Job Creation Law.The results of the study indicate that there are several differences in the wage system before and after the implementation of the Job Creation Law, including in terms of the objectives and basic concepts of minimum wage determination, wage structure and scale, types of minimum wage, minimum wage provisions, and wage payment regulations.Changes in the protection of workers' rights following the enactment of the Job Creation Law create complex impacts. On one hand, this law provides positive benefits, one of which is the guarantee of overtime pay for workers. This is expected to improve their welfare and clarify the financial rights they should receive. However, on the other hand, there are also negative impacts that need to be addressed. One of the main issues is the threat to decent and fair working conditions, particularly regarding the wages received by workers. Some workers may find themselves in situations where their wages do not reflect a reasonable standard of living and are not commensurate with their contributions. This underscores the need for greater attention to the balance between policies that support employers and the protection of workers' rights so that no party is disadvantaged.
