Abstract

Penelitian ini membahas soal perlindungan konsumen terhadap overclaim atas kandungan dan manfaat produk skincare. Tujuan dari penelitian ini yaitu Pertama, untuk mengevaluasi efektivitas pengawasan pemerintah terhadap praktik overclaim skincare. Kedua, untuk mengevaluasi kesadaran konsumen terhadap praktik overclaim produk skincare dan upaya konsumen untuk melindungi diri. Penelitian ini merumuskan pertanyaan penelitian yaitu sebagai berikut: 1) bagaimana pengawasan terhadap produk skincare yang overclaim atas kandungan dan manfaat oleh pelaku usaha, dan 2) bagaimana perlindungan hukum terhadap konsumen atas overclaim kandungan dan manfaat produk skincare. Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian hukum yuridis normatif. Jenis data yang digunakan yaitu data sekunder yang terdiri dari bahan hukum primer seperti peraturan perundang-undangan yang berlaku. Bahan hukum sekunder yang digunakan mencakup buku, jurnal dan artikel ilmiah yang otoritatif lainnya. Bahan hukum tersier yang digunakan misalnya kamus-kamus hukum dan internet. Adapun kesimpulan dari penelitian yaitu, pertama, Pengawasan terhadap produk skincare yang overclaim melibatkan peran penting pemerintah, masyarakat, LPKSM, dan BPOM. Namun, pengaturan dalam UU 8/1999 terbatas pada penyebaran informasi tanpa tindak lanjut konkret. BPOM, sesuai Perpres 80/2017, memiliki kewenangan lebih luas, termasuk penindakan pelanggaran. Oleh karena itu, diperlukan sinergi antar lembaga dan penguatan regulasi untuk melindungi konsumen secara optimal.Kedua, Perlindungan hukum konsumen terhadap produk skincare yang overclaim mencakup aspek preventif dan represif. Perlindungan preventif dilakukan melalui penguatan regulasi, pengawasan oleh pemerintah, masyarakat, BPOM, dan LPKSM dari produksi hingga penjualan. Perlindungan represif mencakup penindakan hukum, kompensasi, dan ganti rugi bagi konsumen. Berdasarkan UU 8/1999, upaya ini bertujuan menjamin hak konsumen atas informasi, keamanan, dan kenyamanan, serta memberi efek jera bagi pelaku usaha yang melanggar / This research discusses consumer protection against overclaims regarding the content and benefits of skincare products. The objectives of this research are: First, to evaluate the effectiveness of government supervision of skincare overclaim practices. Second, to evaluate consumer awareness of skincare overclaim practices and consumer efforts to protect themselves. This research formulates the following research questions: 1) How is the supervision of skincare products that overclaim content and benefits by business actors carried out, and 2) How is legal protection for consumers against overclaims of content and benefits of skincare products carried out? The type of research used in this study is normative legal research. The type of data used is secondary data consisting of primary legal materials such as applicable laws and regulations. Secondary legal materials used include books, journals, and other authoritative scientific articles. Tertiary legal materials used include law dictionaries and the internet. The conclusion of the research is, first, supervision of skincare products that overclaim involves the important role of the government, society, consumer protection organizations, and the BPOM. However, the regulations in Law No. 8/1999 are limited to the dissemination of information without concrete follow-up. The BPOM, in accordance with Presidential Regulation No. 80/2017, has broader authority, including the enforcement of violations. Therefore, synergy between institutions and strengthening regulations is needed to optimally protect consumers. Second, consumer legal protection against overclaiming skincare products covers preventive and repressive aspects. Preventive protection is carried out through strengthening regulations, supervision by the government, society, BPOM, and consumer protection organizations from production to sales. Repressive protection includes law enforcement, compensation, and compensation for consumers. Based on Law No. 8/1999, these efforts aim to guarantee consumers' rights to information, safety, and comfort, and to deter business actors who violate the law
