Kejahatan kekerasan seksual banyak terjadi pada kaum Perempuan mengingat secara struktural memiliki posisi yang lemah dan rentan untuk menjadi korban kekerasan seksual, maka harus mendapatkan perlindungan hukum, namun perlindungan yang berikan belum diimplementasikan secara optimal sehingga menimbulkan Viktimisasi Sekunder terutama dalam Sistem Peradilan Pidana tahap penyidikan oleh aparat kepolisian. Viktimisasi Sekunder yang ditimbulkan oleh aparat kepolisian membawa akibat hukum bagi aparat kepolisian sehingga menimbulkan sanksi bagi yang melanggar larangan tersebut sebagaimana telah diatur dalam peraturan perundang-undangan yang berlaku. Tujuan penelitian untuk memecahkan suatu persoalan hukum dan melakukan sebuah penemuan hukum atas akibat hukum yang menimbulkan tindakan Viktimisasi Sekunder terutama dalam tahap penyidikan, serta pengembangan hukum pidana kedepannya. Pendekatan penelitian adalah normatif dengan pendekatan perundang-undangan, Kode Etik, buku, jurnal, dan lain sebagainya. Hasil yang diperoleh dari penulisan ini bahwa Viktimisasi Sekunder timbul saat Sistem Peradilan Pidana berlangsung yang ditimbulkan oleh aparat kepolisian dalam tahap penyidikan dimana perlindungan yang diberikan telah diatur dalam KUHAP, UU TPKS, UU Kepolisian dan Kode Etik Kepolisian. Akibat hukum bagi aparat kepolisian yang menimbulkan Viktimisasi Sekunder bagi korban tidak diatur dalam UU Kepolisian namun diatur dalam Kode Etik Kepolisian sebagaimana mengatur sanksi administratif bagi aparat kepolisian dari ringan hingga berat yakni Pemberhentian Dengan Tidak Hormat / Sexual violence crimes are predominantly committed against women, given their structurally weaker position, which makes them vulnerable to becoming victims of sexual violence. Therefore, they should receive legal protection. However, the protection provided has not been optimally implemented, leading to secondary victimization, particularly within the criminal justice system during the investigation phase by police officers. The secondary victimization caused by the police officers results in legal consequences for the officers, leading to sanctions for those who violate the prohibitions as regulated in the applicable laws and regulations. The purpose of this research is to address a legal issue and provide a legal discovery regarding the legal consequences arising from actions of secondary victimization, especially during the investigation phase, as well as the future development of criminal law. The research approach is normative, using statutory, ethical codes, books, journals, and other related sources. The findings of this research indicate that secondary victimization occurs during the criminal justice process, specifically during the investigation phase by police officers, where protection measures are regulated in the Criminal Procedure Code (KUHAP), the Law on the Elimination of Sexual Violence (UU TPKS), the Police Law, and the Police Code of Ethics. Legal consequences for police officers causing secondary victimization to victims are not explicitly regulated in the Police Law but are governed by the Police Code of Ethics, which stipulates administrative sanctions ranging from mild to severe, including Dismissal Without Honor
