Penelitian ini membahas terkait dengan penerapan cyber notary menggunakan sistem elektronik. Dinamika dalam masyarakat memungkinkan penggunaan teknologi informasi dan komunikasi dalam berbagai aspek kehidupan, sehingga memunculkan konsep cyber notary. Konsep Cyber Notary menitikberatkan pada penggunaan teknologi informasi dan komunikasi, sehingga salah satu aspek di mana notaris menjalankan tugasnya dengan menerapkan teknologi digital dalam transaksi atau hubungan hukum dimana dalam penelitian ini terkait pembentukan akta notaris berbasis sistem elektronik. Penelitian ini menggunakan metode penelitian hukum normatif empiris. Penerapan cyber notary menjadi penting untuk diteliti karena peraturan perundang-undangan yang berlaku di Indonesia saat ini tidak sejalan dengan perkembangan yang ada, sehingga menyebabkan tidak adanya kepastian hukum dalam penerapan konsep pembentukan akta notaris elektronik. Oleh karena itu perlu dilakukan rekonstruksi hukum yaitu dengan dibentuk regulasi terkait akta elektronik dengan sistem elektronik serta penyesuaian UUJN dan UU ITE agar dapat memungkinkan, termasuk pembaharuan substansi-substansi hukum lain yang berkaitan dengannya pembaharuan struktur hukum kenotariatan, yang meliputi antara lain pembaharuan, atau penataan terhadap struktur atau perangkat terutama terkait dengan sistem elektronik serta pembaharuan budaya hukum kenotariatan. / This research discusses matters related to the implementation of cyber notary using an electronic system. The dynamics in society enable the use of information and communication technology in various aspects of life, thus giving rise to the concept of cyber notary. The concept of Cyber Notary emphasizes the use of information and communication technology, thus becoming one aspect where the notary carries out their duties by applying digital technology in legal transactions or relationships, in which in this research is related to the formation of notarial deeds based on an electronic system. This research uses normative empirical legal research methods. The implementation of cyber notary becomes important to study because the prevailing laws and regulations in Indonesia at present are not aligned with the existing developments, thus causing the absence of legal certainty in the implementation of the concept of electronic notarial deed formation. Therefore, it is necessary to carry out legal reconstruction, namely by forming regulations related to electronic deeds with an electronic system as well as adjustment of the UUJN and the ITE Law to make it possible, including renewal of other legal substances related to it, renewal of the structure of notarial law, which includes among others the renewal or arrangement of the structure or apparatus especially related to the electronic system, as well as the renewal of the notarial legal culture.
