Abstract
Keterlambatan penyusunan Mining Code oleh International Seabed Authority (ISA) telah memunculkan persoalan krusial dalam kepastian hukum pelaksanaan Deep Seabed Mining (DSM) di wilayah dasar laut internasional. Penelitian ini mengkaji: bagaimana kepastian hukum pelaksanaan DSM terdampak oleh keterlambatan, dan bagaimana peran strategis pemerintah Indonesia dalam merespons dinamika tersebut. Penelitian merupakan penelitian hukum normatif dengan pendekatan terhadap asas-asas hukum yang dilakukan terhadap bahan-bahan hukum primer. Melalui analisis terhadap kerangka teori kepastian hukum, ditelaah sejauh mana elemen kepastian hukum, telah terpenuhi dalam rezim hukum ISA. Hasil penelitian menunjukkan bahwa keterlambatan regulasi berimplikasi pada krisis normatif yang mengancam efektivitas ISA dan membuka peluang tindakan sepihak dari negara pihak maupun non-pihak. Dalam konteks Indonesia, kepastian hukum menuntut respons yang selaras antara kewajiban internasional dan kerangka hukum nasional serta penting bagi Indonesia untuk menempatkan posisi secara lebih strategis dalam rezim DSM. Tesis merekomendasikan agar ISA segera mengesahkan Mining Code secara inklusif dan ilmiah; negara pihak aktif mendorong penyelesaiannya; dan negara non-pihak mempertimbangkan partisipasi dalam LOSC; Indonesia perlu segera menyampaikan instrumen hukum yang dimiliki kepada ISA agar tercatat secara resmi dalam basis data ISA, sebagai bentuk pemenuhan kewajiban internasional juga sebagai pernyataan posisi resmi Indonesia dalam diskursus internasional mengenai DSM. / The delay in finalizing the Mining Code by the International Seabed Authority (ISA) has raised critical concerns over legal certainty in Deep Seabed Mining (DSM) in international waters. This study examines how the delay affects legal certainty and the strategic role of the Indonesian government in addressing this challenge. Using a normative legal method and focusing on legal principles, the study analyzes primary legal materials to assess whether the ISA regime meets key elements of legal certainty, including normative clarity, predictability, and enforceability. The findings show that regulatory delays have led to a normative gap that undermines the ISA’s authority and opens opportunities for unilateral actions by State Parties and non-Parties alike. For Indonesia, ensuring legal certainty requires aligning international obligations with domestic legal frameworks and adopting a more strategic position within the DSM regime. The study recommends that the ISA expedite the adoption of the Mining Code through an inclusive, science-based process; that State Parties actively support its completion; and that non-Parties reconsider accession to the LOSC. Furthermore, Indonesia should promptly submit its legal instruments to the ISA as part of fulfilling its international obligations and asserting its official stance in the global DSM discourse.
