Notaris dalam hal membuat akta autentik diakui oleh undang-undang maka notaris berarti mempunyai kedudukan dan jabatan yang sangat mulia, memiliki harkat dan martabat yang tinggi karena jabatan notaris diberikan oleh pemerintah atas nama negara untuk memenuhi kebutuhan masyarakat dalam bidang hukum keperdataan.Upaya menjaga nama baik jabatan notaris, dalam melaksanakan tugasnya notaris memiliki larangan-larangan tertentu yang wajib dipatuhi, notaris juga tidak boleh melakukan pekerjaan lain yang bertentangan dengan norma agama, kesusilaan atau kepatutan yang dapat mempengaruhi kehormatan dan martabat notaris berdasarkan ketentuan perundang-undangan dan kode etik profesi. Isu hukum yang dibahas dalam penulisan ini yaitu bagaimana akibat hukum notaris yang merangkap jabatan, serta kedudukan akta yang dikeluarkan oleh notaris tersebut. Metode yang digunakan dalam penelitian ini menggunakan legal research, yaitu suatu pendekatan alternatif yang menguji studi doktrinal terhadap hukum berkenaan dengan isu hukum yang dikaji yaitu akibat hukum kedudukan notaris dan akta yang dibuatnya serta dikaitkan dengan teori kepastian hukum sebagai landasan bahwa peraturan yang telah dibuat dan diundangkan berjalan dengan jelas, logis, dan tidak menimbulkan multi tafsir. Hasil yang menjadi pembahasan penulisan ini memaparkan bahwa akibat hukum notaris yang merangkap jabatan sebagai advokat, maka jabatan notarisnya tidak semata-mata berlaku sebagaimana ketentuan perundangan dan kode etik profesi, dan akibat hukum akta yang diterbitkan notaris apabila notaris tersebut merangkap jabatan adalah setara dengan perjanjian di bawah tangan atau batal demi hukum. Konklusi yang dihasilkan dalam penelitian ini tidak diperkenankannya notaris merangkap jabatan guna menjaga organisasi profesi notaris agar tidak terjadi conflict of interest, sedangkan akibat hukum akta yang dibuat ketika notaris terkena sanksi akibat rangkap jabatan hilang wujud akta autentiknya. / Notary in terms of making an authentic deed is recognized by law, the notary has a very noble position, high status and dignity because the position of notary is given by the government on behalf of the state to meet the needs of the community in the field of civil law. Efforts to safeguard the good name of the notary public, in carrying out their duties have certain prohibitions that must be obeyed, the notary may also not perform other work that is contrary to religious norms, decency or propriety that can affect the honor and dignity of the notary based on statutory provisions and professional code of ethics. The legal issues discussed in this research are, how do the legal consequences of a notary who concurrently hold a position, and the impact of a deed issued by a notary who is sentenced to multiple service. The method used in this study uses legal research, which is an alternative approach that examines the doctrinal study of the law with regard to the legal issues studied, namely due to the legal position of the notary and the deed he made and is associated with the theory of legal certainty as the foundation that the regulations that have been made and enacted walk clearly, logically, and does not cause multiple interpretations. The results discussed in this research explain that due to the legal notary who concurrently serves as an advocate, the notary profession does not apply solely as stipulated in the legislation and professional code of ethics, and due to the legal deed issued by a notary public when the notary concurrently holds a position is equivalent to the agreement in underhanded or null and void. The conclusions produced in this study are not permitted notaries to concurrently hold positions in order to protect the notary professional organization in order to avoid conflicts of interest, while the legal consequences of a deed made when a notary public are penalized as a result of a double position are lost in the form of an authentic deed.
