Abstract

Tanah merupakan benda yang bernilai ekonomi tinggi. Tanah bisa menjadi keperluan dan juga menjadi modal investasi, maka tanah seringkali diperjual belikan. Untuk melindungi pihak penjual dan pembeli, maka kepemilikan hak atas tanah harus segera didaftarkan setelah terjadinya jual beli. Peralihan Hak Atas Tanah harus dibuktikan dengan akta yang dibuat oleh PPAT. Seluruh proses peralihan hak atas tanah telah diatur dalam ketentuan perundang-undangan. Peraturan yang secara khusus mengatur peralihan hak atas tanah adalah Peraturan Pemerintah Nomor 24 Tahun 1997 Tentang Pendaftaran Tanah. Dalam prakteknya masih banyak PPAT yang tidak bertanggungjawab dengan mengabaikan ketentuan-ketentuan dalam peraturan tersebut. Penelitian ini mengangkat permasalahan mengenai tanggungjawab PPAT dalam proses peralihan hak atas tanah dan bagaimana akibat hukum terhadap akta peralihan yang dibuat dengan melanggar ketentuan dalam kasus Putusan Nomor 120/pdt.g/2018/PN.Tng. Penelitian ini adalah penelitian yuridis-normatif. Hasil dari penelitian ini adalah PPAT bertanggungjawab memastikan semua proses dari awal pengecekan hingga pendaftaran berjalan sesuai ketetentuan yang berlaku. Apabila PPAT mengabaikan ketentuan-ketentuan, maka dapat dikenakan sanksi administratif berupa teguran tertulis sampai pemberhentian dari jabatannya sebagai PPAT, dengan tidak mengurangi kemungkinan dituntut ganti kerugian oleh pihak-pihak yang menderita kerugian yang diakibatkan oleh diabaikannya ketentuan-ketentuan tersebut. Akibat hukum terhadap seluruh akta-akta yang dibuat dengan melanggar ketentuan yang berlaku ialah menyebabkan akta tersebut hanya mempunyai kekuatan dibawah tangan, sehingga proses peralihan dapat diajukan pembatalan. / Land is a high economic value object. Land can be a necessity and also an investment capital, so land is often traded. To protect the seller and buyer, ownership of land rights must be registered immediately after the sale and purchase. The transfer of land rights must be proven by a deed made by the PPAT. The entire process of transferring land rights has been regulated in statutory provisions. The regulation that specifically regulates the transfer of land rights is Government Regulation Number 24 of 1997 concerning Land Registration. In practice there are still many PPAT who are not responsible by ignoring the provisions in the regulation. This research raises the issue regarding the responsibility of PPAT in the process of transferring rights to land and how the legal consequences of the deed made in violation of the provisions in the case of Decision Number 120 / pdt.g / 2018 / PN.Tng. This research is a juridical-normative research. The results of this study are that PPAT is responsible for ensuring all processes from the initial check up to the registration proceed according to the applicable provisions. If the PPAT ignores the provisions, then administrative sanctions in the form of written warning may be imposed until the dismissal from his position as PPAT, without reducing the possibility of being sued by those who suffer losses resulting from the disregard for these provisions. The legal consequence of all deeds made in violation of applicable provisions is to cause the deed to only have the power under the hand, so that the transfer process can be submitted for cancellation.
