Kontrak proyek konstruksi merupakan salah satu hal yang paling krusial dalam proses kerja sama untuk pembuatan suatu proyek. Hak dan kewajiban dalam kontrak disusun menjadi suatu perjanjian tertulis untuk mengalihkan risiko dari pengguna ke penyedia jasa. Di dalam UU No. 2 Tahun 2017 pasal 1 ayat 8 menyebutkan bahwa Kontrak Kerja Konstruksi adalah keseluruhan dokumen kontrak yang mengatur hubungan hukum antara Pengguna Jasa dan Penyedia Jasa dalam penyelenggaraan Jasa Konstruksi. Pemahaman dan pelaksanaan kontrak tersebut menjadi dasar untuk mengoptimalkan penyelenggaraan proyek konstruksi. Tipe kontrak yang sering digunakan di Indonesia berdasarkan ketentuan KemenPUPR RI, mengutip (sebagian) sistem kontrak luar negeri seperti FIDIC (Fédération Internationale Des Ingénieurs-Conseils), JCT (Joint Contract Tribunals) atau AIA (American Institute of Architects). Penggunaan tipe kontrak di Indonesia masih kurang jelas dan pembuatan tipe kontrak mengambil acuan dari berbagai sumber sehingga sering terjadi kesalahpahaman terhadap isi dan pelaksanaan kontrak kerja konstruksi. Permasalahan penelitian yang akan diselesaikan dalam penelitian ini antara lain mengkaji filosofi kontrak proyek konstruksi di Indonesia, mengkaji kontrak konstruksi secara umum, dan studi kontrak proyek konstruksi menurut standar FIDIC. Metode penelitian yang digunakan dalam penelitian ini adalah metode kualitatif untuk mengkaji literatur dan hasil penelitian yang relevan sebagai data sekunder untuk menyusun rekomendasi rekomendasi tujuan penelitian ini dan metode kuantitatif untuk mengolah data kuesioner dan menjawab permasalahan penelitian. Penelitian mencapai pada kesimpulan bahwa kontrak proyek konstruksi merupakan alat mengalihkan risiko dari pengguna ke penyedia jasa dalam proses pelaksanaan proyek konstruksi maka dibutuhkan wajah kontrak yang spesifik sehingga dapat digunakan secara menyeluruh di Indonesia. Dari sudut pandang kontraktor didapatkan 20 klausul kontrak kondisi umum FIDIC yang dianggap penting untuk menjadi rekomendasi dalam pembuatan kontrak proyek konstruksi./ Contract within any construction project is one of the most crucial aspects in the process of cooperation in a project. The rights and obligations set within the contract create a written agreement to shift risks from the employer (client) to the contractor (service provider). The Law of Indonesia, UU No. 2 Tahun 2017 pasal 1 ayat 8, states that construction project contract is a contract document that regulates the legal relationship between Employer (Service User) and Contractor (Service Provider) within the performance of a Construction Service. The understanding and implementation of said contract is the foundation in optimizing the performance of a construction project. Common types of contracts used in Indonesia are based on provisions made by the Ministry of Public Works and Housing, quoting (some parts) from international contracts such as FIDIC (Fédération Internationale Des Ingénieurs-Conseils), JCT (Joint Contract Tribunals) or AIA (American Institute of Architects). The implementation of types of contracts in Indonesia is still unclear and the drafting of these types of contracts from multiple sources create misunderstanding towards the contents and execution of the construction project contract. The research goals for this paper includes to study the philosophy behind contracts of construction projects in Indonesia, to study the types of contracts in general construction, and to study types of contracts from the FIDIC standards. The research method used in this paper is qualitative methods for studying literature and previous research as secondary data to compose practical recommendations from this research. Quantitative method is also used to process all data from the questionnaire in order to answer the research questions. Research concludes that construction contract shifts risk from the client to the service provider in execution of a construction project; for that purpose, a specific form of contract needs to be crafted to be utilized all across Indonesia. From the contractor’s point of view, there are 20 contract clauses within FIDIC general condition of contract that are important for them to be recommended as a part of forming the construction project contract.
