Abstract
Perkembangan pemanfaatan teknologi internet dan komunikasi seperti smartphone mendorong berkembangnya bisnis perdagangan secara elektronik. Saat ini alat pembayaran juga mengalami digitalisasi yaitu dengan hadirnya dompet elektronik (electronic wallet) dan mulai digunakan masyarakat dalam melakukan transaksi. Perkembangan digitalisasi alat pembayaran penggunaan Dompet Elektronik diperlukan juga kesadaran dan perlindungan konsumen dan masyarakat terkait perlindungan data pribadi dan dampak dari penyalahgunaan data pribadi. Peran Bank Indonesia (BI) sebagai pengawas jalannya Penyelenggaraan Dompet Elektronik mengeluarkan peraturan terkait pelaksanaan Dompet Elektronik yaitu Peraturan Bank Indonesia (PBI) 18/40/PBI/2016 tentang Penyelenggaraan Pemrosesan Transaksi Pembayaran. Terkait dengan perlindungan konsumen pengguna Dompet Elektronik dapat dilihat di dalam Peraturan Bank Indonesia (PBI) Nomor 16/1/PBI/2014 tentang Perlindungan Konsumen Jasa Sistem Pembayaran. Untuk melihat efektifitas perlindungan konsumen terhadap pengguna Dompet Elektronik, maka diperlukan penelitian Peraturan Perundangan di Bidang Perbankan dan Undang-Undang Perlindungan Konsumen di Indonesia. Selain itu penelitian tanggung jawab penyelenggara Dompet Elektronik juga diperlukan sebagai bentuk kepastian hukum bagi para pengguna Dompet Elektronik apabila terjadi kebocoran data pribadi.
Pengumpulan data dilakukan dengan menggunakan pendekatan perundang-undangan, yaitu dengan menelaah undang-undang dan regulasi yang bersangkut paut dengan isu hukum yang sedang diteliti. Hasil penelitian tersebut, dapat disimpulkan bahwa pengaturan mengenai perlindungan data pribadi bagi pengguna Dompet Elektronik belum cukup mengatur perlindungan hukum terhadap data pribadi dan hak konsumen atas perlindungan data pribadi belum diatur secara khusus, sehingga hak-hak privasi pengguna Dompet Elektronik hanya ditemukan dalam beberapa peraturan perundangan yang tidak diatur secara khusus. Prinsip tanggung jawab terhadap perlindungan data pribadi pengguna Dompet Elektronik yang seharusnya digunakan adalah prinsip pertanggung jawaban mutlak, karena pada dasarnya pelaku usaha mempunyai kewajiban untuk menjaga kerahasiaan data pribadi konsumen sehingga konsumen dapat menuntut ganti rugi kepada pelaku usaha dalam hal ini Penyelenggara Dompet Elektronik tanpa harus mengajukan atau membawa bukti kesalahan. / The development of the use of internet and communication technologies such as smartphones has encouraged the development of electronic commerce business. Currently the payment instrument is also digitizing, namely the presence of an electronic wallet and is starting to be used by the public in conducting transactions. The development of digitizing payment instruments for the use of Electronic Wallet also requires awareness and protection of consumers and the public related to the protection of personal data and the impact of misuse of personal data. The role of Bank Indonesia (BI) as the supervisor of the running of the Electronic Wallet Operates a regulation related to the implementation of the Electronic Wallet, namely Bank Indonesia Regulation (PBI) 18/40 / PBI / 2016 concerning the Implementation of Payment Transaction Processing. Related to consumer protection for Electronic Wallet users can be seen in Bank Indonesia Regulation (PBI) Number 16/1 / PBI / 2014 concerning Consumer Protection for Payment System Services. To see the effectiveness of consumer protection for Electronic Wallet users, it is necessary to research the Regulations in the Banking Sector and the Consumer Protection Act in Indonesia. In addition, research into the responsibilities of Electronic Wallet organizers is also needed as a form of legal certainty for Electronic Wallet users in the event of personal data leakage.
Data collection is carried out using a legislative approach, namely by examining the laws and regulations that are relevant to the legal issues being examined. The results of this study, it can be concluded that the regulation regarding personal data protection for Electronic Wallet users is not sufficient to regulate the legal protection of personal data and the consumer's right to protect personal data has not been specifically regulated, so that the privacy rights of the Electronic Wallet user are only found in a number of laws and regulations. which is not specifically regulated. The principle of responsibility for the protection of personal data of Electronic Wallet users that should be used is the principle of absolute responsibility, because basically businesses have an obligation to maintain the confidentiality of personal data of consumers so that consumers can claim compensation to business actors in this case Electronic Wallet Providers without having to file or bring evidence of error
