The patent right is part of the intellectual property rights (IPR) as a right which arises from the result of one’s mind which results in a product or process which is useful for mankind. The protection towards patents which has/have been registered is a right for the patent holder. The protection itself is not obtained automatically without any prior registration. The registration is done in order to obtain certainty on the protection in case an unwanted violation occurs in the future. A person or a group of person which registers their discovery will have an exclusive patent right upon their discovery. Which for a certain period of time conducts their discovery personally or provides their consent to another party to conduct their discovery. As for the legal protection upon a patent, it is required by the inventor as the owner of patent license to be able to create, sell, import, rent, hand over, use and provide such patented product / good to be sold or rented. Patent is an exclusive right given based on the Law to a person or group of person which discovers an invention. The annulment of a patent is an annulment towards such exclusive right. Such annulment can be conducted due to the following reasons: annulment by law (void by law), the annulment by request of the patent holder, annulment of patent due to a claim / lawsuit. The research method within this research is the statute and case research method. Which is by analyzing all the laws and regulations which relate to the legal issue being handled and by analyzing the case which is linked to the relevant laws applicable in Indonesia. The result of this research’s analysis is to understand the requirements of pattern granting, the regulation on patent registration, and how the regulation on patent novelty is linked with case Number 075/PK/Pdt.Sus/2009 pursuant to Law Number 14 Year 2001 regarding Patent.
