Abstract
Land acquisition for the implementation of development in the public interest by the government or regional government is carried out by releasing or surrendering land rights or revoking land rights. The form of authority granted by law is to take action by forcibly taking and controlling one's land in the public interest. A striking difference between the revocation of land rights and land acquisition is that if the revocation of land rights is done by force, the land acquisition is carried out based on the principle of deliberation. The legal consequence of land acquisition for public use is the determination of land compensation based on the assessment of the appraisal team (independent price estimator). The range of compensation value is determined by the appropriateness of the value of the land price based on the sale and purchase transaction and the Sales Value of the Tax Object (NJOP) with reference to the results of the deliberation. Settlement of disputes between public and the Government of DKI Jakarta was people sued the DKI Jakarta Provincial Government to the South Jakarta District Court to ask for compensation in the amount of 120 million per meter. In the Supreme Court Decision Number 2544K/ PDT /2017, The Judge decided the case for compensation for land acquisition for people of Jalan Fatmawati, South Jakarta, related to the construction of the Mass Rapid Transit (MRT). The author uses normative legal research with an approach to law and case approach. Based on the decision of the Supreme Court, the Government of DKI Jakarta required to pay compensation for residents' land at a value of 30 million per meter according to the appraisal or market price of the land to the plaintiffs. This value is lower than what the South Jakarta District Court judge decided, which is 60 million per meter.
