Abstract

Pada periode 2004-2009 terdapat kasus-kasus penyiksaan terhadap tenaga kerja Indonesia(TKI), meskipun dianggap remeh akan tetapi masalah TKI merupakan masalah yang mempengaruhi hubungan Malaysia dan Indonesia. TKI merupakan salah satu kunci era industi Malaysia dan bagi Indonesia TKI merupakan “pahlawan devisa” Terlihat bahwa kasus-kasus yang menimpa TKI semakin meningkat tiap tahun tetapi tidak membuat jumlah TKI yang ada di Malaysia berkurang akan tetapi bertambah, inilah kenapa penting isu ini diselesaikan oleh kedua negara. Penelitian ini bertujuan untuk melihat respons yang diberikan oleh pemerintah Indonesia. Penulis menggunakan prespektif Liberalisme Institusional, konsep Kerjasama Internasional, Kerjasama Bilateral dan Civil Society dalam penelitian ini. Untuk mencapai tujuan penelitian ini, metode peneletian yang digunakan adalah deskriptif dengan teknik pengumpulan data melalui penelitian perpustakaan yang bersumber dari buku, jurnal, dokumen, dan situs daring yang valid. Dalam menanggapi kasus-kasus tersebut terdapat hasil Kerjasama Internasional berupa MoU antara Indonesia dan Malaysia yang tercipta untuk dijadikan perlindungan hukum terhadap TKI. Organisasi Internasional seperti ILO juga berperan penting dalam perlindungan terhadap TKI berupa bantuan dalam pembuatan undang-undang perlindungan terhadap TKI dan pembentukan BNP2TKI sebagai sarana Lembaga perlidungan TKI. Organisasi non-pemerintahan (NGOs) seperti Migran Care juga ikut berperan dalam hak-hak TKI yang di Malaysia yaitu memberikan bantuan hukum terhadap TKI yang bermasalah, mengkaji kebijakan yang dimana di anggap kurang melindungi TKI di Malaysia, memberikan dan berkerjasama dengan ILO dan pemerintahan Indonesia dalam melindungi hak-hak TKI.Hasil dari penelitian menunjukan bahwa meskipun telah terdapat respon yang dihasilkan keduanegara dalam bentuk perlindungan hukum terhadap TKI akan tetapi dengan masih adanya kasus, maka pemerintah melakukan moratorium atau pemberhentian pengiriman TKI./In the period 2004-2009 there were abuse cases of Indonesian migrant workers (TKI), although it was underestimated, the problem of migrant workers is a problem that affects relations between Malaysia and Indonesia. TKI are one of the keys to the Malaysian industrial era and for Indonesia migrant workers are "Pahlawan Devisa". It appears that cases toward migrant workers are increasing every year, but not reducing the number of migrant workers in Malaysia instead it is increasing, this is why it is important to resolve this issue by both country. The author uses the perspective of Institutional Liberalism, International Cooperation, Bilateral Cooperation and Civil Society Concept in explaining the Indonesian government's response to the case of TKI. To achieve the objectives of this research, the research method used by the author is descriptive with data collection techniques through library research sourced from books, journals, documents and online sites. In responding to these cases there was the result of an International Cooperation in the form of an MoU between Indonesia and Malaysia created to serve as legal protection toward TKI. International organizations such as the ILO also play an important role in the protection of TKI in the form of assistance in law makings for the protection of TKI and the formation of BNP2TKI as a means for the protection of TKI. Non-governmental organizations (NGOs) such as Migrant Care also play a role in the rights of migrant workers in Malaysia, namely providing legal assistance to TKI case, reviewing policies which are considered to be less protective of TKI in Malaysia, providing and collaborating with the ILO and the Indonesian government in protecting the rights of migrant workers. The results of the research show that although there have been responses generated by both countries in the form of legal protection against migrant workers, but with cases still present, the government conducted a moratorium or the termination of sending migrant workers.
