Abstract

Praktiknya perjanjian pinjam meminjam dapat terjadi dalam ruang lingkup subjek orang perorangan yang didasarkan atas dasar kepercayaan. Perjanjian pinjam meminjam dilakukan dengan sederhana dengan membuat perjanjian pinjam meminjam dan terhadap jaminan tanah bersertifikat yang diberikan tersebut dibuatkan perikatan jaminan tersebut dalam Perikatan jual beli tanah dimana seolah-olah telah terjadi jual beli padahal hubungan kedua belah pihak adalah pinjam meminjam. Berdasarkan hal tersebut maka muncul rumusan masalah tentang aturan hukum pinjam meminjam antara orang perorangan dengan menggunakan jaminan kepemilikan sertifikat tanah menurut peraturan perundang-undangan yang berlaku dan keabsahan eksekusi jaminan pada saat debitur wanprestasi pada perjanjian pinjam-meminjam dimana jaminan diperbuat dengan menggunakan sarana perikatan perjanjian jual beli. Penelitian ini menggunakan Metode penelitian yang bersifat yuridis normatif. Dari penelitian diketahui peraturan hukum tentang pinjam meminjam dalam Kitab Undang-Undang Hukum Perdata diatur dalam Pasal 1754 dan berkaitan dengan pinjam meminjam disertai pemberian jaminan diatur dalam Undang-Undang Hak Tanggungan Nomor 4 Tahun 1996 yang harus diikat dengan Sertifikat Hak Tanggungan. Sementara itu keabsahan eksekusi objek jaminan sertifikat hak atas tanah pada saat debitur perorangan wanprestasi dengan menggunakan akta jual beli tidak sah karena tidak memiliki korelasi dengan perjanjian pinjam meminjam, jaminan yang berupa sertifikat tanah harus diikat dengan menggunakan produk dari Badan Pertanahan nasional berupa sertifikat hak tanggungan sesuai dengan ketentuan peraturan hukum yang berlaku./ In practice, lending and borrowing agreements can occur within the scope of the subject of individuals who are based on trust. The borrowing and borrowing agreement is carried out simply by making a borrowing and borrowing agreement and the collateral for the certified land provided is made into a land sale and purchase agreement where it is as if a sale and purchase has taken place even though the relationship between the two parties is borrowing and borrowing. Based on this, a problem formulation arises regarding the legal rules of borrowing and borrowing between individuals using land certificate ownership guarantees according to the applicable laws and regulations and the validity of the execution of guarantees when the debtor is in default in the loan-borrowing agreement where the guarantee is made by means of a sale agreement. buy. This study uses a normative juridical research method. From the research, it is known that the legal regulations regarding lending and borrowing in the Civil Code are regulated in Article 1754 and relating to borrowing and lending accompanied by the provision of guarantees are regulated in the Mortgage Law Number 4 of 1996 which must be tied with a Mortgage Certificate. Meanwhile, the validity of the execution of the object of guarantee of land rights certificates when the individual debtor defaults by using a deed of sale and purchase is invalid because it does not have a correlation with the loan agreement, the guarantee in the form of a land certificate must be bound by using a product from the National Land Agency in the form of a mortgage certificate in accordance with with the provisions of the applicable legal regulations.
