Abstract

The Bank provides subsidized credit facility for house ownership for low-income people with land and simple house as collateral objects. Bank Tabungan Negara (BTN) Bekasi Branch is one of implementing banks, and the bank as a creditor and debtor is bound in a credit agreement which constitutes as an underlying agreement. To guarantee the settlement of its debt, the debtor makes Power of Attorney Imposing Collateral Right, Debt Acknowledgment Certificate and Authority to Sell Certificate as an accesoir collateral agreement. Problems would arise when a debtor breaches the agreement, by neglecting land and house collateral, the debtor does not have a good will and Collateral Right is not attached to collateral which leads BTN to be concurrent creditor. Effort and protection against a concurrent creditor is by carrying out execution upon nonperforming credit collateral by selling it before the public based on Authority to Sell Certificate and Debt Acknowledgment Certificate which are made before a notary. This research is a kind of jurisdic and normative study, that is, a research that uses legislation approach, legal principles, and bibliographical materials which are related to the problem. It was concluded that the execution of nonperforming credit collateral based on Authority to Sell Certificate and Debt Acknowledgement Certificate could be carried out specially for subsidized credit with the object of simple house and the debtor did not have a good will, and notarial deed or Certificates of Authority to Sell and Debt Acknowledgement were made separately from credit agreement. Notary and Land Deed Officer are required to better understand both subjective requirements and objective requirements in drawing up Sale and Purchase Certificates based on Authority to Sell Certificate and Debt Acknowledgement Certificate as the basis of the execution of non-performing credit collateral, and in giving legal opinions to creditor it is advised to impose Collateral Right as a guarantee institution in accordance with the existing legislations. / Bank memberikan fasilitas kredit bersubsidi kepemilikan rumah bagi masyarakat berpenghasilan rendah, dengan obyek jaminan tanah dan rumah sederhana, Bank Tabungan Negara (BTN) Cabang Bekasi salah satu bank pelaksana, bank selaku kreditur dan debitur terikat dalam perjanjian kredit yang merupakan perjanjian pokok, untuk menjamin pelunasan hutangnya debitur membuat Surat Kuasa Membebankan Hak Tanggungan, Akta Pengakuan Hutang dan Akta Kuasa Menjual sebagai perjanjian pengikatan jaminan yang bersifat accesoir, permasalahan timbul saat debitur wanprestasi, menelantarkan agunan tanah dan rumah, debitur raib (debitur tidak beretikad baik) dan tidak dipasangnya Hak Tanggungan atas agunan, mengakibatkan BTN sebagai kreditur konkuren. Upaya dan perlindungan terhadap kreditur konkuren adalah melakukan eksekusi jaminan kredit macet dengan cara penjualan dimuka umum dengan dasar Akta Kuasa Menjual dan Akta Pengakuan Hutang yang dibuat secara notariil. Penelitian ini merupakan penelitian yang bersifat yuridis normatif, yaitu penelitian menggunakan pendekatan perundang-undangan, asas-asas hukum, dan bahan pustaka yang berkaitan dengan permasalahan. Diperoleh suatu kesimpulan bahwa eksekusi jaminan kredit macet berdasarkan Akta Kuasa Menjual dan Akta Pengakuan Hutang dapat dilaksanakan khusus untuk kredit bersubsidi dengan obyek rumah sederhana dan debitur tidak beretikad baik, dan akta notariil Kuasa Untuk Menjual dan Akta Pengakuan Hutang dibuat terpisah dari perjanjian kredit. Notaris dan Pejabat Pembuat Akta Tanah dituntut untuk lebih memahami syarat subyektif dan syarat obyektif dalam pembuatan Akta Jual Beli berdasarkan Akta Kuasa Menjual dan Akta Pengakuan Hutang sebagai dasar eksekusi jaminan kredit macet, dan memberikan pendapat hukum kepada kreditur agar tetap melakukan pemasangan Hak Tanggungan sebagai lembaga jaminan sesuai undang-undang.
