Abstract

Andre Naba (01051180134) PERLINDUNGAN HAK CIPTA LAGU YANG DIARANSEMEN ULANG DALAM PENGGUNAANNYA DI SOSIAL MEDIA TIK TOK (CXLII + 117 halaman: 3 gambar; 1 diagram; 1 lampiran) Skripsi ini berjudul “Perlindungan Hak Cipta Lagu yang Diaransemen Ulang Dalam Penggunaannya Di Sosial Media Tik Tok”. Dalam penulisannya menggunakan metode penelitian bersifat normatif, dengan menggunakan pendekatan asas-asas Hukum dan pendekatan terhadap sistematika Hukum. Rumusan masalah dalam penelitian ini adalah: (1) Bagaimana perlindungan hukum Hak Cipta atas lagu di Indonesia? (2)Bagaimana implementasi perlindungan hukum Hak Cipta lagu terhadap aransemen ulang yang disebarkan di aplikasi Tik Tok? Dari penelitian hukum yang dilakukan dengan menggunakan penelitian yang disebutkan dapat disimpulkan bahwa, pada rumusan masalah pertama perlindungan Hak Cipta lagu di Indonesia sudah diatur dan dilaksanakan dengan baik. Dalam Undang-Undang No.28 Tahun 2014 Tentang Hak Cipta dijelaskan mengenai bagaimana prosedur melakukan transformasi ciptaan. Sedangkan dalam rumusan masalah kedua dalam aplikasi Tik Tok sudah ada ketentuan yang melarang pelanggaran Hak Cipta akan tetapi aturan perundang�undangan di Indonesia belum secara khusus mengatur mengenai penggunaan karya transformasi yang digunakan di media sosial. Kata Kunci : Hak Cipta, Lagu, Aransemen, Tik Tok / Andre Naba (01051180134) COPYRIGHT PROTECTION OF RE-ARRANGED SONGS FOR USE IN TIK TOK SOCIAL MEDIA (CXLII + 117 pages: 2 figures; 1 diagram; 1 appendices) This thesis is entitled "Copyright Protection of Re-arranged Songs in Their Use on Tik Tok Social Media". In writing it uses a normative research method, using a legal principles approach and an approach to legal systematics. The formulation of the problems in this study are: (1) How is the legal protection of copyrights for songs in Indonesia? (2) How is the implementation of song copyright law protection against rearrangements that are distributed on the Tik Tok application? From the legal research conducted using the aforementioned research, it can be concluded that, in the first formulation of the problem, copyright protection for songs in Indonesia has been regulated and implemented properly. In Law No. 28 of 2014 concerning Copyright, it is explained about the procedure for transforming creations. Whereas in the second formulation of the problem in the Tik Tok application there are already provisions prohibiting copyright infringement, but the laws and regulations in Indonesia do not specifically regulate the use of transformation works used on social media.
