Abstract

Akta Jual Beli adalah bentuk kesepakatan yang dilakukan oleh pihak penjual dan pihak pembeli yang berisi kewajiban penjual menyerahkan tanah atau bangunan, sedangkan pihak pembeli wajib membayar harga yang telah disepakati oleh kedua pihak. Perbuatan hukum tersebut dibuat di hadapan PPAT disertai saksi. Akta yang dibuat oleh PPAT merupakan akta autentik yang menjadi alat bukti kuat secara hukum sebagai dasar pengalihan sertifikat hak atas tanah di Kantor Pertanahan Nasional. Pada prakteknya saat ini masih terdapat PPAT yang menjalankan kewenangannya,khususnya yang dalam membuat akta autentik yang tidak sesuai dengan ketentuan Undang-Undang yang berlaku. Diantaranya PPAT membuat Akta Jual Beli, tanpa dihadiri oleh pemilik tanah yang sah. Penelitian ini dilakukan untuk mengetahui pengaturan mengenai perjanjian jual beli tanah di Indonesia, dan mengetahui legalitas Akta Jual Beli yang dibuat oleh PPAT tanpa kehadiran pemilik tanah yang sah. Penelitian tesis ini menggunakan metode penelitian normatif yang didukung dalam kajian empiris. Adapun data yang digunakan mencakup Data Primer yang diperoleh, dari hasil wawancara dengan Notaris/PPAT, serta data sekunder yang diperoleh dari bahan kepustakaan atau literatur misalnya jurnal, maupun buku-buku hukum. Hasil penelitian menyimpulkan bahwa legalitas Akta Jual Beli tersebut tidak memiliki kepastian hukum sebagai dasar untuk mendapatkan perlindungan hukum bagi pemilik sah atas tanah dan bangunan yang diperjual belikan tersebut. Berdasarkan keputusan pengadilan yang berkekuatan hukum tetap, maka pemilik tanah dapat memperoleh kepastian hukum dan perlindungan hukum. Dalam kaitan ini, PPAT juga dapat dimintakan pertanggung jawaban secara perdata karena telah melakukan perbuatan melawan hukum / The Deed of Sale and Purchase is a form of agreement made by the seller and the buyer which contains the obligation of the seller to hand over the land or building, while the buyer is obliged to pay the price agreed by both parties. The legal action was made before the Conveyancer Officer accompanied by witnesses. The deed made by Conveyancer Officer is an authentic deed that becomes legally strong evidence as the basis for transferring land title certificates at the National Land Office. In practice, there are still Conveyancer Officer that exercise their authority, especially those in making authentic deeds that are not in accordance with the provisions of the applicable law. Among them, Conveyancer Officer makes a Sale and Purchase Deed, without being attended by the legal landowner. This research was conducted to determine the arrangements regarding land sale and purchase agreements in Indonesia, and to find out the legality of the Sale and Purchase Deed made by Conveyancer Officer without the presence of a legal landowner. This thesis research uses normative research methods supported in empirical studies. The data used include primary data obtained, from interviews with Notary / Conveyancer Officer, as well as secondary data obtained from literature materials such as journals, and law books. The results of the study concluded that the legality of the Sale and Purchase Deed did not have legal certainty as a basis for obtaining legal protection for the legal owner of the land and buildings being traded. Based on court decisions with permanent legal force, landowners can obtain legal certainty and legal protection. In this connection, Conveyancer Officer can also be held civilly liable for committing unlawful acts.
