Abstract
Penelitian ini bertujuan pertama, untuk mengetahui tata cara dari melakukan
permohonan pengecekan sertifikat tanah dan syarat-syarat yang harus dipenuhi
untuk dapat pengecekan sertifikat tanah. Kedua, manfaat dari pengecekan
sertifikat tanah sebelum melakukan perbuatan hukum jual beli.
Penelitian ini menggunakan metode penelitian yang bersifat normatif yaitu
penelitian yang dilakukan dengan mengkaji hukum tertulis dari berbagai aspek,
yaitu aspek teori, sejarah, filosofi, perbandingan, struktur dan komposisi, lingkup
dan materi, konsistensi, penelasan umum, dan pasal demi pasal, analisis yang
berhubungan dengan judul penelitian ini. Sumber data yang digunakan dalam
penelitian ini adalah bahan hukum primer, sekunder, dan tersier.
Hasil penelitan yang diperoleh dari penulisan ini adalah: Pertama, tata cara
pengecekan sertifikat tanah sesuai Peraturan Menteri Negara Agraria/Kepala
Badan Pertanahan Nasional Nomor 3 Tahun 1997 Tentang Ketentuan Pelaksanaan
Peraturan Pemerintah Nomor 24 Tahun 1997 Tentang Pendaftaran Tanah, yang
wewenangnya dimiliki oleh Badan Pertanahan Nasional (BPN) sebagai instansi
yang akan melakukan pengecekan dan syarat-syarat dan kewajiban yang harus
dipenuhi oleh Pemohon untuk memohonkan pengecekan sertifikat tanah sebelum
dilakukannya perbuatan jual-beli agar timbul kepastian hukum perbuatan jual-beli.
Badan Pertanahan Nasional (BPN) sebagai instansi yang berwenang melakukan
pengecekan sertifikat tanah akan melaksanakan kewajibannya untuk melakukan
pengecekan dengan menyesuaikan data fisik dan yuridis antara sertifikat yang
dimohonkan dengan buku tanah yang dimiliki oleh BPN. Kedua, manfaat
pengecekan sertifikat tanah oleh pihak-pihak berkepentingan sebelum
dilaksanakannya perbuatan jual-beli, dan terhadap PPAT mengapa pengecekan
sertifikat tanah sebelum dibuatnya akta yang memuat perbuatan jual-beli
merupakan suatu kewajiban./This study aims to: First, to find the prosedures for request application of
land checking certificate and conditions that must be fulfilled to be able to land
certificate checking. Second, the benefits of land certificate checking before
carrying out legal actions of buying and selling.
This study uses a normative research menthod, namely research conducted
bu examining written law fromm various aspects, namely aspects of theory,
history, philosophy, comparison, structure and composition, scope and material,
consistency, general explanation, and article by article, analysisi that related to the
title of this research. Sources of data used in this study are primary, secondary,
and tertiary legal materials.
The research result obtained from this writing are: First, the procedure for
land certificate checking according to the Regulation of the State Minister of
Agrarian Affairs/Head of the National Land Agency Number 3 of 1997
concerning Provisions for the Implementation of Government Regulation Number
24 of 1997 concerning Land Registration, whose authority is owned by the
National Land Agency (BPN) as the agency that will carry out checks and the
terms and obligations that must be fulfilled by the applicant to request land
certificate checking before carrying out the act of buying and selling in order to
create legal certainty for the act of buying and selling. National Land Agency
(BPN) as the agency authorized to check land certificate will carry out its
obligations to check by adjusting the physical and juridical data between
certificate that been apply for and the land book that owned by National Land
Agency. Second, the benefits of land certificate checking by interested parties
prior to the implementation of the buying and selling act, and for Land Deed
Official why checking the land certificate before making a deed that containing
the act of buying and selling is an obligation.
