Abstract

Masyarakat Indonesia, khususnya yang berada di daerah perkotaan, sangat tidak terpisahkan dari internet, karena hampir segala aktifitas selalu melibatkan internet dan teknologi informasi. Jadi, tak heran jika internet kini menjadi kebutuhan pokok bagi sebagian kalangan, terutama bagi mereka yang menggunakan internet untuk keperluan bisnis (E-commerce). Salah satu saran online penjualan obat illegal adalah E-commerce sebagai akses transaksi melalui media online. Melalui transaksi perdagangan tersebut, maka jual beli konvensional tidak berlaku lagi, dan E-commerce telah menjadi salah satu alternatif perdagangan untuk konsumen Penjualan obat telah diatur dalam pasal 196 Undang-Undang Kesehatan, sehingga semua penjualan harus memenuhi persyaratan atau prosedur sesuai dengan aturan tersebut. Praktiknya masih ada orang yang menjual obat penggugur kandungan tanpa izin. Penelitian ini menyimpulkan bahwa pihak marketplace bertanggung jawab secara pidana dalam jual beli obat ilegal penggugur janin secara online. Temuan penelitian menunjukkan bahwa pihak marketplace memiliki kewajiban untuk melakukan pengawasan dan pencegahan terhadap transaksi penjualan obat ilegal di platformnya. Namun, dalam beberapa kasus yang diteliti, terdapat bukti yang kuat bahwa pihak marketplace tidak melakukan langkah-langkah yang memadai untuk mencegah penjualan obat ilegal, seperti kurangnya mekanisme verifikasi penjual, pemantauan iklan yang melanggar hukum, dan ketidaktertarikan dalam menghapus penawaran obat ilegal. / Indonesian society, especially those in urban areas, is inseparable from the internet, because almost all activities always involve the internet and information technology. So, it is not surprising that the internet has now become a basic need for some groups, especially for those who use the internet for business purposes (E-commerce). One of the online suggestions for selling illegal drugs is E-commerce as access to transactions via online media. Through these trade transactions, conventional buying and selling no longer applies, and E-commerce has become an alternative trade for consumers. Drug sales are regulated in Article 196 of the Health Law, so all sales must meet the requirements or procedures in accordance with these regulations. In practice, there are still people selling abortion drugs without a permit. This research concludes that the marketplace is criminally responsible for buying and selling illegal abortion drugs online. Research findings show that marketplaces have an obligation to monitor and prevent illegal drug sales transactions on their platforms. However, in several cases studied, there was strong evidence that marketplaces did not take adequate steps to prevent the sale of illegal drugs, such as a lack of seller verification mechanisms, monitoring of unlawful advertisements, and a disinterest in removing illegal drug offers.
