Abstract

The legal ramifications of having numerous land title certificates for the same property owing to inaccuracies, errors, and neglect by the Head of the Land Office result in a lack of clarity and confusion over ownership rights to the property or land. The issue at hand pertains to the sufficiency of regulations governing the issuance of land certificates in ensuring legal certainty for land certificate holders. Additionally, it raises concerns about the legal protection available to land ownership certificate holders in cases involving the issuance of multiple certificates, as outlined in Decision Number 38/G/2021/PTUN.Bdg. The research methodology used in this study is empirical normative juridical legal research, which is a mix of normative juridical legal research and empirical juridical research. The study utilizes both primary and secondary data. The three methodologies used are the legislative approach, case approach, and conceptual approach. Based on the findings of this study, it can be inferred that the laws governing the issue of land certificates in Indonesia are adequate in ensuring legal certainty for land certificate holders. The land rights holders are granted legal protection in the event of a double certificate issuance, as stated in Decision Number 38/G/2021/PTUN.Bdg. Specifically, the plaintiffs, who are the rights holders, receive legal protection in accordance with PP No. 24 of 1997, and Article 19 paragraph (2) letter c, Article 23 paragraph (2), Article 32 paragraph (2), and Article 38 paragraph (2) of the UUPA. These provisions establish that the letters of proof of rights serve as compelling evidence. Land rights holders involved in disputes do not obtain legal protection after their land certificate is revoked due to their adherence to a land registration system known as a negative publication system, which includes positive aspects. / Akibat hukum dari banyaknya sertifikat hak atas tanah karena ketidak akuratan, kekeliruan, dan kelalaian Kepala Kantor Pertanahan mengakibatkan ketidakjelasan dan kerancuan hak milik atas barang atau tanah tersebut. Persoalan tersebut berkaitan dengan belum memadainya regulasi yang mengatur penerbitan sertifikat tanah dalam menjamin kepastian hukum bagi pemegang sertifikat tanah. Selain itu, hal ini juga menimbulkan kekhawatiran mengenai perlindungan hukum bagi pemegang sertifikat kepemilikan tanah dalam kasus-kasus yang melibatkan penerbitan sertifikat ganda, sebagaimana dituangkan dalam Keputusan Nomor 38/G/2021/PTUN.Bdg. Metodologi penelitian yang digunakan dalam penelitian ini adalah penelitian hukum yuridis normatif empiris, yaitu perpaduan antara penelitian hukum yuridis normatif dan penelitian yuridis empiris. Penelitian ini menggunakan data primer dan sekunder. Tiga metodologi yang digunakan adalah pendekatan legislasi, pendekatan kasus, dan pendekatan konseptual. Berdasarkan temuan penelitian ini, dapat disimpulkan bahwa peraturan perundang-undangan yang mengatur penerbitan sertifikat tanah di Indonesia sudah memadai dalam menjamin kepastian hukum bagi pemegang sertifikat tanah. Pemegang hak atas tanah diberikan perlindungan hukum apabila terjadi penerbitan sertifikat ganda, sebagaimana tertuang dalam Keputusan Nomor 38/G/2021/PTUN.Bdg. Secara khusus, penggugat yang merupakan pemegang hak mendapat perlindungan hukum sesuai dengan PP Nomor 24 Tahun 1997, dan Pasal 19 ayat (2) huruf c, Pasal 23 ayat (2), Pasal 32 ayat (2), dan Pasal 38 ayat (2) UUPA. Ketentuan ini menetapkan bahwa surat bukti hak merupakan alat bukti yang meyakinkan. Para pemegang hak atas tanah yang bersengketa tidak mendapatkan perlindungan hukum setelah sertipikat tanahnya dicabut karena menganut sistem pendaftaran tanah yang dikenal dengan sistem publikasi negatif yang memuat aspek positif.
