Abstract

Sistem pendaftaran tanah merupakan satu kesatuan kegiatan dalam suatu sistem administrasi untuk seluruh bidang tanah dan sekaligus merupakan manifestasi kepastian hukum atas tanah. Sertipikat adalah bukti hak atas tanah yang diterbitkan oleh Kantor Pertanahan yang bertujuan untuk memberikan kepastian hukum kepada pemilik tanah. Terbitnya dua sertipikat atas tanah atas sebidang tanah dapat menimbulkan suatu permasalahan hukum, mengingat sertipikat memiliki fungsi sebagai alat bukti hak atas tanah maupun hak tanggungan, dan sedangkan pemilik asli tanah dengan sertipikat ganda tersebut juga perlu diberikan jaminan hukum serta perlindungan hukum. Kewenangan untuk melakukan pembatalan terhadap sertifikat hak atas tanah yang dianggap cacat berada pada Kepala Badan Pertanahan Nasional Republik Indonesia, tetapi dalam Putusan Nomor 48/G/2021/PTUN-Mdn, justru Badan Pertanahan Nasional yang menyebabkan kecacatan pada sertifikat tanah yang seharusnya memberi kepastian hukum pada masyarakat dan mengakibatkan sertipikat tanah kedua tersebut dibatalkan. Kelalaian yang dilakukan Badan Pertanahan Nasional ini merupakan tindakan Maladministrasi yang dapat dilaporkan pada lembaga Ombudsman Republik Indonesia. Penelitian ini bertujuan untuk meneliti unsur kelalaian Badan Pertanahan Nasional yang menyebabkan terbitnya sertipikat tanah menjadi ganda dan konsekuensi yuridis terhadap sertipikat ganda yang terbukti terbit akibat kelalaian Badan Pertanahan Nasional. Penelitian ini merupakan penelitian yuridis empiris yang menggunakan pendekatan Judicial Case Study, yaitu pendekatan studi kasus hukum karena konflik sehingga akan melibatkan campur tangan dengan pengadilan untuk memberikan keputusan penyelesaian. / The land registration system is a unified process within an administrative system for all land parcels and serves as a manifestation of legal certainty over land ownership. A certificate is a legal proof of land rights issued by the Land Office, aimed at providing legal certainty to the landowner. The issuance of two certificates for a single plot of land can create legal issues, given that certificates serve as evidence of both land rights and collateral rights. The original landowner holding these dual certificates also needs legal assurance and protection. The authority to annul a land title certificate deemed defective lies with the Head of the National Land Agency of the Republic of Indonesia. However, in Decision No. 48/G/2021/PTUN-Mdn, it was the National Land Agency itself that caused the defect in the certificate, which should have provided legal certainty to the public, leading to the annulment of the second land certificate. The negligence by the National Land Agency constitutes maladministration, which can be reported to the Indonesian Ombudsman. This study aims to examine the elements of negligence by the National Land Agency that resulted in the issuance of dual land certificates, as well as the legal consequences for these dual certificates, which were proven to have been issued due to the Agency’s negligence. This is an empirical legal study using a Judicial Case Study approach, focusing on legal cases involving conflicts that require court intervention to resolve the dispute.
