Abstract
Perjanjian sewa-menyewa merupakan suatu bentuk kesepakatan antara pihakpemilik objek perjanjian dengan penyewa, yang masing-masing pihak memiliki
kewajiban (prestasi), sehingga apabila kewajiban tersebut tidak dipenuhi maka hal
itu dikatakan sebagai tindakan wanprestasi. Pada penelitian ini terdapat
permasalahan yaitu terkait bentuk wanprestasi yang terjadi antara PTAnugerahPertiwi Mandiri dengan Lies Kencana Soemardi terkait perjanjian sewa-menyewaruko dan pertimbangan Hakim pada Putusan Nomor: 268/Pdt.G/2023/PNJkt.Sel
dalam penyelesaian wanprestasi. Tujuan penelitian ini adalah untuk memahami
bentuk wanprestasi yang terjadi dalam perjanjian sewa-menyewa antara antara PTAnugerah Pertiwi Mandiri dengan Lies Kencana Soemardi dan menganalisispertimbangan hakim dalam Putusan Nomor: 268/Pdt.G/2023/PN Jkt.Sel. Metodepenelitian yang digunakan dalam penelitian ini yaitu penelitian hukumnormatif. Jenis data yang digunakan adalah data sekunder (bahan hukumprimer, bahanhukum sekunder, dan bahan hukum tersier). Teknik pengumpulan data denganstudi kepustakaan. Pendekatan dalam penelitian ini yaitu Pendekatan terhadapperaturan perundang-undangan dan pendekatan terhadap kasus. Data dianalisissecara kualitatif. Hasil penelitian yang pertama memperlihatkan adanya bentukwanprestasi, yaitu pihak penyewa yaitu PT Anugerah Pertiwi Mandiri tidakmemenuhi kewajibannya yaitu membayar uang sewa tahun kedua dan membayar
angsuran iuran keamanan dan kebersihan ruko, biaya pemindahan barangPTAnugerah Pertiwi Mandiri dari ruko dan biaya untuk menyewa gedunggunamenyimpan barang miliknya. Hasil penelitian yang kedua, Pertimbangan Hakimdalam Putusan Nomor: 268/Pdt.G/2023/PN Jkt.Sel. yaitu Hakimmenolak gugatandari PT Anugerah Pertiwi Mandiri (Penggugat) karena tidak dapat membuktikandalil gugatannya dan mengabulkan sebagian rekonvensi Lies Kencana Soemardi
(Tergugat) karena hanya sebagian kerugian yang dapat dibuktikan. Kerugianyangdapat dibuktikan sebesar Rp50.576.000,- (lima puluh juta lima ratus tujuh puluhenam rupiah), sehingga ganti rugi yang dibayarkan oleh PT Anugerah Pertiwi
Mandiri kepada Lies Kencana Soemardi sejumlah Rp50.576.000,- (lima puluhjuta lima ratus tujuh puluh enam rupiah)./ Lease Agreement is one of the agreement between the voter of agreement object
party and lessee, each of parties have obligation (performance), therefore if it doesnot fulfill then it is called as default act. In this research there are problems whichrelated to happened default between PT Anugerah Pertiwi Mandiri andLiesKencana Soemardi regarding shop house lease agreement and Judge considerationin Verdict Number: 268/Pdt.G/2023/PN Jkt.Sel in default settlement. The aimof
this study is to comprehend default type that is happened in lease agreement
between PT Anugerah Pertiwi Mandiri and Lies Kencana Soemardi and analysisthe judge consideration in Verdict Number: 268/Pdt.G/2023/PNJkt.Sel. Theresearch method in this study was normative law research. Data usedwassecondary data (primary law materials, secondary law materials, and tertiarylawmaterials). Technique of collecting data was literature review. Approach of thisstudy that is laws and regulations approach and case approach. Data analysingwill conducted qualitatively. The first study showed that there was default type, that is the lessee party is PT Anugerah Pertiwi did not fulfill its obligation topayannually lease money and installment payment for shop-house securityandcleanliness, goods movement fee of PT Anugerah Pertiwi Mandiri fromthe shophouse and building lease fee to keep its goods. The second result is that the JudgeConsideration in Verdict Number: 268/Pdt.G/2023/PN Jkt.Sel. where the Judgecanceled the lawsuit from PT Anugerah Pertiwi Mandiri (Plaintiff) since it couldnot prove its lawsuit agreement and partially granted Lies Kencana Soemardi
(Defendant) counterclaim since it is only part of the detriment can be proven. Thedetriment that can be proven is Rp50.576.000,- (fifty million five hundredandseventy-six rupiah), therefore, the compensation paid by PT Anugerah Pertiwi
Mandiri to Lies Kencana Soemardi was Rp50.576.000,- (fifty millionfivehundred and seventy-six rupiah).
