Abstract
Penelitian ini membahas pelaksanaan dan kedudukan hukum Hak Guna Bangunan (HGB) di atas tanah yang berstatus Hak Pengelolaan Lahan (HPL) dalam sistem
hukum agraria nasional. HGB merupakan hak atas tanah yang bersifat kebendaan dan dapat dimiliki oleh subjek hukum tertentu untuk mendirikan dan memiliki bangunan di atas tanah yang bukan miliknya, sedangkan HPL adalah bentuk penguasaan administratif negara yang didelegasikan kepada lembaga atau instansi tertentu untuk mengelola tanah negara. Dalam hal ini Undang-Undang Nomor 6 Tahun 2023 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 tentang Cipta Kerja mengakomodasi secara definitif
ketentuan hukum Hak Guna Bangunan (HGB) diatas Hak atas Pengelolaan (HPL), justru menimbulkan ketidakpastian hukum. Perbedaan aturan undang undang yang
berlaku dengan pengaturan yang berbeda beda akan memicu perselisihan seperti yang diatur dalam UUPA. Oleh karena itu, permasalahan yang akan dikaji yaitu mekanisme pelaksanaan dan kedudukan hukum Hak Guna Bangunan (HGB) di atas Hak Pengelolaan Lahan (HPL) berdasarkan Undang Undang Pokok Agraria Nomor 5 Tahun 1960 dan Undang-Undang Cipta Kerja Nomor 6 Tahun 2023. Tujuan
penelitian adalah memberikan kepastian hukum terhadap kedudukan dan mekanisme pengaturan prosedur Hak Guna Bangunan (HGB) di atas Hak Pengelolaan Lahan (HPL) Tesis ini menggunakan metode penelitian hukum normatif empiris dan pengumpulan data dengan cara studi kepustakaan, serta menguji kualitas substansi norma hukum, sehingga analisisnya bersifat kualitatif.
Hasil penelitian menunjukkan bahwa hubungan hukum antara HGB dan HPL tidak jarang menimbulkan sengketa, terutama ketika terjadi tumpang tindih kewenangan
atau ketika HGB diterbitkan lebih dahulu sebelum HPL ditetapkan, seperti pada kasus Hotel Sultan dan Kawasan Ancol. Pelaksanaan HGB di atas HPL sangat
bergantung pada persetujuan pemegang HPL, baik dalam perpanjangan, pengalihan, maupun pembebanan hak. Ketentuan ini menimbulkan ketidakpastian
hukum bagi pemegang HGB, terutama jika tidak ada pengaturan atau perjanjian yang tegas antara kedua belah pihak. Sayangnya secara normatif UUPA tidak
mengklasifikasikan Hak Pengelolaan sebagai bagian dari hak atas tanah, tidak ditemui pengaturan mengenai hak tersebut dalam UUPA karena selama ini hanya bergantung dari Hak Menguasai dari Negara, dan UUCK justru merestrukturisasi jangka waktu perpanjangan HGB diatas HPL sehingga terjadi disharmonisasi meskipun memberikan kepastian hukum. Oleh karena itu, DPR dan Pemerintah
perlu melakukan revisi terhadap UUPA terkait dengan pemberian HGB di atas HPL, dan ketentuan lain yang belum diatur dalam UUPA dan secara definitif UUCK mengubah UUPA sama dengan ketentuan yang ada di UUCK sebagai
harmonisasi hukum. / This study discusses the implementation and legal status of Building Use Rights
(HGB) on land with Land Management Rights (HPL) status in the national agrarian law system. HGB is a land right that is material in nature and can be owned by certain legal subjects to build and own buildings on land that is not theirs,
while HPL is a form of state administrative control that is delegated to certain institutions or agencies to manage state land. In this case, Law Number 6 of 2023 concerning the Stipulation of Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation definitively accommodates the legal provisions of Building Use Rights (HGB) above Management Rights (HPL), but instead creates
legal uncertainty. Differences in applicable laws and regulations with different regulations will trigger disputes as regulated in the UUPA. Therefore, the problem to be studied is the implementation mechanism and legal status of Building Use Rights (HGB) over Land Management Rights (HPL) based on the Basic Agrarian Law Number 5 of 1960 and the Job Creation Law Number 6 of 2023. The purpose
of the study is to provide legal certainty regarding the status and mechanism for regulating the procedures for Building Use Rights (HGB) over Land Management Rights (HPL). This thesis uses empirical normative legal research methods and data collection by means of literature studies, as well as testing the quality of the substance of legal norms, so that the analysis is qualitative. The results of the study
show that the legal relationship between HGB and HPL often causes disputes, especially when there is an overlap of authority or when HGB is issued before HPL
is determined, as in the case of the Sultan Hotel and the Ancol Area. The implementation of HGB over HPL is highly dependent on the approval of the HPL holder, both in extensions, transfers, and burdens of rights. This provision creates legal uncertainty for HGB holders, especially if there are no clear regulations or agreements between the two parties. Unfortunately, UUPA normatively does not
classify Management Rights as part of land rights, there is no regulation regarding these rights in UUPA because so far it has only depended on the Right to Control from the State, and UUCK actually restructures the extension period for HGB
above HPL so that disharmony occurs even though it provides legal certainty. Therefore, the DPR and the Government need to revise the UUPA related to the
granting of HGB above HPL, and other provisions that have not been regulated in UUPA and definitively UUCK changes UUPA to be the same as the provisions in UUCK as legal harmonization.
