Abstract

Perjanjian Pengikatan Jual Beli (PPJB) berfungsi dan mempunyai tujuan untuk mempersiapkan, menegaskan, memperkuat, mengatur, mengubah atau menyelesaikan suatu hubungan hukum, apabila hal-hal yang telah disepakati dalam PPJB telah dilaksanakan seutuhnya. Perjanjian Pengikatan Jual Beli (PPJB) yang biasanya dilakukan oleh pengembang, pada umumnya dilakukan dengan cara pembeli melakukan pembayaran secara bertahap sesuai dengan jadwal yang telah ditentukan. Namun demikian, permasalahan timbul ketika kontraktor mendapatkan kuasa dari pemilik tanah melalui perjanjian kerjasama secara lisan untuk membangun, menawarkan serta menjual unit-unit rumah tersebut kepada masyarakat/ calon pembeli, namun di perjalanan, kontraktor tersebut melakukan wanprestasi hingga konsumen tidak mendapatkan hak-haknya atas kepemilikan tanah yang telah dibelinya. Penelitian ini menggunakan metode normatif-empiris. Hasil dari penelitian ini bahwa pertama keabsahan akta PPJB tanah sebagai dasar pembuatan AJB tanah atas dasar perjanjian kerjasama antara kontraktor dengan pemilik tanah dalam rangka peralihan hak atas tanah adalah sah dikarenakan telah melewati beberapa fase, yaitu dimulai dari fase prakontrak/perbuatan para pihak yang melakukan perjanjian; kemudian pada fase kontrak, yaitu dalam bentuk isi kontrak yang disepakati para pihak tidak bertentangan dengan undang-undang, kesusilaan yang baik, atau ketertiban umum. Terakhir pada fase pascakontrak/pelaksanaan isi perjanjian yang telah disepakati. Kedua, konsep PPJB di masa akan datang dalam upaya menjamin terciptanya kepastian hukum atas peralihan hak atas tanah adalah Perjanjian Pengikatan Jual Beli (PPJB) Lunas dalam bentuk akta otentik, maka dalam waktu paling lambat 90 hari sejak PPJB tersebut lunas, wajib dilakukan penandatanganan Akta Jual Beli. Apabila pelaksanaan penandatangan Akta Jual Beli tersebut tidak dilakukan sampai batas waktu yang ditentukan, maka demi hukum, PPJB tersebut dapat diakui sebagai AJB dan dapat diteruskan ke Badan Pertanahan Nasional untuk proses penerbitan sertipikat tanah. / The Sales and Purchase Agreement (PPJB) functions and has the aim of preparing, confirming, strengthening, regulating, changing or resolving a legal relationship, if the matters agreed upon in the PPJB have been fully implemented. The Sale and Purchase Agreement (PPJB) which is usually carried out by developers, is generally carried out by the buyer making payments in stages according to a predetermined schedule. However, problems arise when the contractor obtains authority from the land owner through a verbal cooperation agreement to build, offer and sell the housing units to the public/potential buyers, but along the way, the contractor defaults so that consumers do not receive their rights to ownership of the land he had purchased. This research uses normative-empirical methods. The results of this research are that firstly, the validity of the land PPJB deed as the basis for making land AJB on the basis of a cooperation agreement between the contractor and the land owner in the context of transferring land rights is valid because it has gone through several phases, namely starting from the pre-contract phase/acts of the parties entering into the agreement. ; then in the contract phase, namely in the form of contract contents agreed by the parties that do not conflict with the law, good morality or public order. Finally, in the post-contract phase/implementation of the contents of the agreed agreement. Second, the concept of PPJB in the future in an effort to guarantee the creation of legal certainty regarding the transfer of land rights is a Full Sale and Purchase Agreement (PPJB) in the form of an authentic deed, so within 90 days of the PPJB being paid in full, a Deed of Sale must be signed. Buy. If the signing of the Deed of Sale and Purchase is not carried out within the specified time limit, then by law, the PPJB can be recognized as AJB and can be forwarded to the National Land Agency for the process of issuing a land certificate.
